SAVREQ Service Purchase Terms (Automatic Shooting Service)
These terms of use (hereinafter referred to as the "Terms") are set by the Sugadaira Cableway Association (hereinafter referred to as the "Association") for the "SAVREQ" cloud service type automatic shooting/online lesson service provided by TOSYS Corporation. (hereinafter referred to as "SAVREQ") to provide paid or free video management and data provision services (hereinafter referred to as "this service").
Article 1 (Service Overview)
This service cooperates with the camera equipment installed by our association and SAVREQ, and the user of this service (hereinafter referred to as "user") shoots video data of themselves on the cloud service. It is a service that provides users with the right to store, manage, and download the video data.
Article 2 (Scope of application)
This agreement shall apply to the scope of services in which transactions or agreements have been confirmed between the Association and users on the SAVREQ service. In addition, as long as there is no priority in this agreement, it is assumed that you agree that the "SAVREQ Terms of Use" will be applied as a premise of using this service.
Article 3 (Establishment of service contract)
The contract for this service is based on the fact that the user uses the SAVREQ service to apply for the purchase of the service to the association (including the purchase processing by the payment agency service or the payment processing of the fee by other methods), The service contract shall be concluded when the association receives the notification. The Association shall not refund the fees paid unless there is a reason attributable to the Association.
Article 4 (Restriction of Use and Termination of Contract)
The Association may, without prior notice, restrict the use of all or part of the Service to the User or cancel the Service Agreement in any of the following cases: will do. The Association shall not be held responsible for any damage caused to the user by this.
(1) Violation of any provision of these Terms;
(2) When it turns out that there is a false fact in the registered items
(3) When one year has passed since the contract for this service was concluded
(4) When the data of the service is deleted due to the user's operation or other reasons
(5) When the user's SAVREQ user registration is canceled due to the user's operation or other reasons
(6) When TOSYS Co., Ltd. terminates the provision of the SAVREQ service;
(7) In addition, when the association determines that the use of this service is not appropriate
Article 5 (Sharing of User Information)
In accordance with the provisions of Article 3 of this agreement, when a service usage contract is established between the user and the Association, the user's registration information and usage information on SAVREQ shall be shared with the Association on the system. In addition, users are deemed to have agreed to the application of the SAVREQ Terms of Use.
Article 6 (Prohibitions)
When using this service, the user shall not do the following acts.
(1) Acts that violate laws or public order and morals ・Acts related to criminal acts
(2) Acts of destroying or interfering with the functions of the association's server or network
(3) Acts that may interfere with the operation of our services
(4) Acts of unauthorized access or attempts to do so
(5) Acts of collecting or accumulating personal information, etc. related to other users
(6) Acts of disclosing information that violates portrait rights or privacy of third parties;
(7) Other acts that the Association deems inappropriate.
Article 7 (Suspension of Provision of the Service, etc.)
The Association may suspend or suspend the provision of all or part of the Service without prior notice to the User if the Association determines that any of the following reasons exist. In addition, the Association shall not be liable for any disadvantage or damage suffered by the user or a third party due to the suspension or interruption of the provision of this service, regardless of the reason.
(1) When performing regular or urgent maintenance and inspections to provide services
(2) When the operation of the service becomes impossible due to an emergency such as fire, power outage, natural disaster, etc.
(3) When the operation of the service becomes impossible due to war, civil war, riot, disturbance, labor dispute, etc.
(4) When the service cannot be provided due to poor service or unauthorized access from a third party, etc.
(5) When the service cannot be provided due to measures based on laws, regulations, etc.
(6) In addition, when the association determines that it is unavoidable
Article 8 (Cancellation)
The User may terminate this Service Agreement at any time by withdrawing from the SAVREQ user registration or deleting the data for the service purchased on the SAVREQ Service.
Article 9 (Disclaimer)
The Association shall not be responsible for the safety, reliability, accuracy, effectiveness, suitability for a particular purpose, security defects, errors, bugs, or infringement of rights regarding the functions, data, and information provided by the Service. including, but not limited to, any warranty. The user shall agree to the matters described below and use this service at his/her own responsibility.
(1) The Association shall not be held responsible under any circumstances for loss of data or other troubles.
(2) All settings, etc. of personal computers, mobile terminals and other devices for using this service shall be carried out at the user's own responsibility. The Association shall not be held responsible for any malfunctions of terminals, etc. that occur as a result of using the Service.
(3) All communication costs incurred in using this service shall be borne by the user.
(4) All issues of privacy or portrait rights of third parties arising from the use of this service shall be handled at the responsibility of the user, and the Association shall not assume any responsibility.
(5) When using this service, the association shall not be responsible for any accidents or troubles that occur during shooting in the service providing facility.
(6) In addition, the Association shall not be liable for any damages to the user arising from the use of this service, or transactions, communications or disputes arising between the user and the service providing facility or a third party. We shall not be held responsible.
Article 10 (Changes to Service Contents, etc.)
The Association may change the content of the Service or discontinue the provision of the Service by notifying the User pursuant to the provisions of Article 12 of this Agreement. The Association shall not be held responsible for any damage caused to the user by this.
Article 11 (Changes to Terms of Use)
If the Association deems it necessary, it shall be possible to change this agreement by notifying the user according to the provisions of Article 12 of this agreement. In addition, if the user starts using this service after changing this agreement, it is assumed that the user has agreed to the changed agreement.
Article 12 (Notice or Contact)
In principle, the Association will notify or contact users by posting on the Association page on the SAVREQ official website. When using this service, the user shall confirm the contents posted on the official website, and the notice from the association to the user shall be the one that reaches the user at the time the user uses this service. and users shall be deemed to have accepted this.
Article 13 (Handling of personal information)
The Association shall properly handle personal information acquired through the use of this service in accordance with the Association's privacy policy.
Article 16 (Governing Law/Jurisdiction)
The law of Japan shall be the governing law for the interpretation of these Terms. In the event of any dispute regarding the Service, the court having jurisdiction over the location of the head office of the Association shall be the exclusive jurisdictional court.
