SAVREQ Service Purchase Terms (Automatic Photography Service)
These Terms of Use (hereinafter referred to as "these Terms") stipulate the terms of use for the video management and data provision service (hereinafter referred to as "this Service") provided by Okushiga Kogen Resort Co., Ltd. (hereinafter referred to as "our company"), which is provided for free or for a fee, using the cloud service-type automatic photography and online lesson service "SAVREQ" (hereinafter referred to as "SAVREQ") provided by TOSYS Co., Ltd.
Article 1 (Service Overview)
This service is a service that links the camera equipment installed by our company with SAVREQ to store and manage video data taken by users of this service (hereinafter referred to as "users") on a cloud service, and provides users with the right to download such video data.
Article 2 (Scope of Application)
These Terms shall apply to the scope of services for which transactions or agreements have been confirmed between our company and users on the SAVREQ service. In addition, unless there are matters that take precedence in these Terms, it is deemed that the "SAVREQ Terms of Use" shall apply as a prerequisite for using this service.
Article 3 (Establishment of a Service Contract)
The contract for this service is established when the user uses the SAVREQ service to apply to the Company for the purchase of the service (including purchase processing via a payment agency service or payment processing by other methods) and the Company receives notification of this. The Company will not refund any fees paid, except in cases where the Company is responsible for such reasons.
Article 4 (Restrictions on Use and Termination of Contract)
The Company may, without prior notice, restrict the user's use of all or part of the Service or terminate the service contract if any of the following conditions apply. The Company shall not be liable for any damages incurred by the user as a result of this.
(1) If you violate any provision of these Terms and Conditions.
(2) If it is discovered that the registered information is false.
(3) If one year has passed since the date of the contract for this service.
(4) If the data for the service is deleted due to the user's operation or for other reasons.
(5) If the user's SAVREQ user registration is cancelled due to the user's operation or for other reasons.
(6) If TOSYS Co., Ltd. terminates the provision of the SAVREQ service.
(7) If the Company otherwise determines that the use of this service is inappropriate.
Article 5 (Sharing of User Information)
In accordance with Article 3 of these Terms and Conditions, if a service contract is concluded between the user and the Company, the user's registration information and usage information in SAVREQ will be shared with the Company on the system. The user is deemed to have agreed to the application of the SAVREQ terms of use.
Article 6 (Prohibited Acts)
When using this service, the user must not engage in the following acts.
(1) Actions that violate laws and regulations or public order and morals; actions related to criminal activities
(2) Actions that destroy or interfere with the functions of our servers or networks
(3) Actions that may interfere with the operation of our services
(4) Actions of unauthorized access or attempts to unauthorized access
(5) Actions of collecting or storing personal information, etc. about other users
(6) Actions of disclosing information that violates the portrait rights or privacy of third parties
(7) Actions of illegally obtaining videos or still images before purchase by taking screenshots, etc.
(8) Other actions that the Company deems inappropriate
Article 7 (Suspension of provision of this service, etc.)
If the Company determines that any of the following reasons exist, the Company may suspend or suspend provision of all or part of this service without prior notice to the user. The Company shall not be liable for any disadvantage or damage suffered by the user or a third party due to the suspension or suspension of provision of this service, regardless of the reason. (1) Periodic or emergency maintenance and inspection for the provision of services.
(2) When the operation of the service becomes impossible due to an emergency such as fire, power outage, or natural disaster.
(3) When the operation of the service becomes impossible due to war, civil unrest, riot, disturbance, labor dispute, etc.
(4) When the service cannot be provided due to a malfunction of the service or unauthorized access from a third party.
(5) When the service cannot be provided due to measures based on laws, regulations, etc.
(6) When the Company deems it unavoidable.
Article 8 (Cancellation)
The user may cancel this service contract at any time by canceling the SAVREQ user registration or deleting the data of the service purchased on the SAVREQ service.
Article 9 (Disclaimer)
The Company does not guarantee any functions, data, or information provided by this service, including defects regarding safety, reliability, accuracy, validity, suitability for a specific purpose, security, etc., errors or bugs, or infringement of rights. The user agrees to the items listed below and shall use this service at his/her own risk.
(1) Under no circumstances shall the Company be liable for any loss of data or other trouble.
(2) The user shall be responsible for all settings of computers, mobile terminals and other devices to use this service. The Company shall not be liable for any malfunctions of terminals, etc. caused by the use of the service.
(3) The user shall be responsible for all communication costs incurred in using this service.
(4) Any issues of privacy or portrait rights of third parties arising from the use of this service shall be handled at the user's own risk, and the Company shall not be liable for any such issues.
(5) In the event of accidents or troubles occurring during shooting within the service providing facility when using this service, the Company shall not be liable under any circumstances.
(6) The Company shall not be liable for any other damages suffered by the user as a result of using this service, or any transactions, communications or disputes between the user and the service providing facility or a third party.
Article 10 (Changes to the Service Content, etc.)
The Company may change the content of the Service or discontinue the provision of the Service by notifying the User in accordance with Article 12 of these Terms. The Company shall not be liable for any damages incurred by the User as a result of such change.
Article 11 (Changes to the Terms of Use)
The Company may change these Terms by notifying the User in accordance with Article 12 of these Terms, if it deems necessary. If the User starts using the Service after the Terms have been changed, the User shall be deemed to have agreed to the changed Terms.
Article 12 (Notification or Contact)
In principle, any notification or contact from the Company to the User shall be made by posting on the Company's page on the SAVREQ official website. The User shall check the posted content on the official website when using the Service, and the notification from the Company to the User shall be deemed to have reached the User at the time the User uses the Service, and the User shall be deemed to have accepted this.
Article 13 (Handling of Personal Information)
The Company will handle personal information acquired through the use of the Service appropriately in accordance with the Company's Privacy Policy.
Article 16 (Governing Law and Jurisdiction)
These Terms and Conditions shall be interpreted in accordance with Japanese law. In the event of a dispute regarding the Service, the court with jurisdiction over the location of the Company's head office shall be the court of exclusive jurisdiction.
